Competition Schedule PART A

1. Competition Name: Falms’ Loyalty Rewards Giveaway

2. Promoter: Falms Activewear (ABN 63 553 054 964). Contact details available at: falms.com.au (Website).

3. Entry Requirements:

To be eligible to enter the Promotion, entrants must:

  • be at least 18 years of age; and
  • reside in Australia (or the Territory as specified in the Promotion details).

Entrants may participate in the Promotion in one of two ways:

(a) by purchasing a Membership Package via the Promoter’s Website, which provides access to special discounts and invitations to VIP events; or

(b) via the free entry method set out below.

Free Entry – No Purchase Necessary: Entry into the Promotion is completely free and no purchase is required. Any person who meets the eligibility criteria above and wishes to enter without purchasing a Membership Package may do so by sending an email to [email protected] during the Promotion Period with the subject line “Free Entry Request – [Exact Promotion Name]”. The email must clearly state the entrant’s full first and last name, state of residence, email address, and phone number. Only one free entry per person is permitted. All valid free entries received will be included in the draw on exactly the same basis as entries linked to a Membership Package purchase. The Promoter will send a confirmation email acknowledging receipt of each valid free entry.

The Entrant will receive a number of entries in the Competition as set out on the Membership Packages page, depending on the Membership Package purchased.

Entries may also be obtained by purchasing specific merchandise on the Promoter’s Website, the number of entries received will be as set out therein.

4. Maximum entries: 10 000 per person.

5. Number of winners: There will be a maximum number of 1 Winner(s).

6 Territories: Australia-wide, excluding South Australia.

7. Promotion Period: Competition commences 12:00am on 9 March 12:00am 2026and ends at 11:59pm on 9 April 2026. If the prize for the final draw is unclaimed, the redraw will occur at 8:00pm on 2 July 2026, with the winner notified by 4 July 2026.

7. Prizes: The winner will receive the prize as set out in the Annexure. For the purposes of this Competition, the total prize pool is estimated to be no more than AUD $2,500.

The Prize consists of a $2,500 voucher to be used with a supercar rental provider of the Winner’s choice, for the purpose of booking a Lamborghini Huracán (or similar vehicle, subject to availability). The Promoter does not own, supply or operate the vehicle and is not a party to any agreement between the Winner and the rental provider.

The Prize must be taken as stated and is not transferable to another person, unless agreed to in writing by the Promoter. The Prize is not exchangeable for other goods or services from the Promoter.

All additional expenses and costs associated with redeeming the Prize are the sole responsibility of the Winner, including but not limited to security deposits, insurance, excess liabilities, fuel, additional kilometres, delivery fees, and any other charges imposed by the rental provider.

The Promoter will not be liable if the Winner is unable to redeem the Prize due to failing to meet the rental provider’s requirements, including but not limited to age, licensing, identification, or security checks.

The Winner may elect to receive a cash alternative of AUD $2,000 instead of the Prize. If the cash alternative is selected, the Winner will not receive the voucher or any associated experience.

The Promoter reserves the right to substitute the Prize with an equivalent cash prize in its sole discretion.

9. Prize date and selection of winners: All entries will be assigned a number, and the Winners will be drawn by a random electronic number generator. The Winners will be drawn on the dates as set out in the Annexure at the Head Office.

10. Publication of winners: Winners will be personally notified by email within 7 days of the draw. Winners will also be announced online at the Promoter’s Website, Instagram and Facebook within 7 days of the draw.

11. Winner eligibility: To be eligible to win, the Entrant’s details provided to us must contain correct and accurate information. Employees of the Promoter and immediate family members of employees of the Promoter are not eligible to win.

12. Prize Delivery: Prizes will be delivered to the Winners to their nominated address or email address (at the Promoter’s discretion) within five (5) business days of confirmation of the Winner’s eligibility.

If the Prize consists of a voucher, it will be delivered electronically to the Winner’s nominated email address.

If the Prize contains a cash prize, it will be delivered to the Winner by bank transfer to their nominated bank account.

The Promoter will not be responsible for any delays, failures, or issues arising from third party providers associated with the redemption or use of the Prize.

The Promoter will pay for the delivery of the Prize where applicable. However, the Winner is responsible for any other costs associated with receipt or use of the Prize, including any taxes or transfer duties or costs.

13. Package Inclusions and Benefits
Trade promotion packages offered by the Promoter provide access to the FALMS discount portal and associated benefits as outlined below. The primary purpose of each package is the provision of access, discounts, and promotional benefits. Any entries into a promotion are provided on a complimentary basis and are incidental to the purchase.

The specific inclusions for each package are as follows:

  • Entry Package: Provides access to the FALMS discount portal for 3 days from the date of purchase, together with a bonus 4 additional days of access, and a 10% discount on eligible merchandise.
  • Basic Package: Provides access to the FALMS discount portal for 7 days from the date of purchase, together with a bonus 7 additional days of access, and a 15% discount on eligible merchandise.
  • Pro Package: Provides access to the FALMS discount portal for 1 month from the date of purchase, together with a bonus 1 additional month of access, and a 25% discount on eligible merchandise.
  • Elite Package: Provides access to the FALMS discount portal for 6 months from the date of purchase, together with a bonus 3 additional months of access, and a 35% discount on eligible merchandise.
  • Ultimate Package: Provides access to the FALMS discount portal for 12 months from the date of purchase, together with a bonus 6 additional months of access, a 50% discount on eligible merchandise, and a $20 referral credit redeemable via approved partner platforms (including ShopBack), subject to third party terms and conditions.

The Promoter may also offer additional products, upgrades, or subscription services, including but not limited to:

  • Elite Upsell: Provides an additional 12 months of FALMS discount portal access on top of any selected package and an additional 30% merchandise discount applied in conjunction with the base package discount, subject to eligibility.
  • Subscription: Provides continued access to the FALMS discount portal following the expiry of any initial package for the duration of the active subscription period. Where purchased in conjunction with a package, an additional 10% merchandise discount may apply on top of the base package discount. Where purchased as a standalone product, a 25% merchandise discount may apply.

All access periods commence from the date and time of purchase unless otherwise stated. Bonus access periods are promotional in nature and may be varied, substituted, or withdrawn at the Promoter’s sole discretion at any time.

Merchandise discounts apply only to eligible products and may be subject to exclusions, limitations, or additional terms as determined by the Promoter. Discounts are not transferable, exchangeable, or redeemable for cash.

Referral credits and any partner offers are subject to the terms and conditions of the relevant third party provider and may be amended or withdrawn without notice.

The Promoter reserves the absolute right, in its sole and unfettered discretion, to modify, substitute, suspend, or discontinue any package inclusions, benefits, or features at any time. Entrants and purchasers acknowledge and agree that any such changes do not give rise to any claim, refund, cancellation, or compensation.

14. Participant Numbers and Advertised Maximum
Marketing and promotional materials for the Promotion may refer to a maximum number of participants in the draw (the “Advertised Maximum”). The Advertised Maximum is an estimate only and does not constitute a fixed, guaranteed, or binding limit.

The Promoter reserves the absolute right, at its sole and unfettered discretion, to accept additional valid entries (including complimentary or free entries) and to increase the total number of participants in the draw at any time, for any reason, including but not limited to higher than anticipated demand or operational requirements.

All valid entries received in accordance with these Terms and Conditions will be included in the draw, irrespective of whether the total number of participants exceeds the Advertised Maximum.

By entering the Promotion or purchasing any associated product, entrants acknowledge and agree that:
(a) the actual number of participants in the draw may exceed the Advertised Maximum; and
(b) any variation in participant numbers, including any resulting impact on the odds of winning, does not give rise to any right to a refund, cancellation, compensation, or other claim against the Promoter.

This applies regardless of any real-time counters, visual indicators, or representations displayed on the Website or in marketing materials, which may not reflect live or final participant numbers.

15. Membership Purchases Purpose and Refunds:

Any purchase of a membership package is made solely and exclusively for the purpose of obtaining access to the discount portal and its associated benefits. Entry into the Promotion (or the chance to win any prize) is strictly incidental and is not the primary or a material purpose of the purchase. Purchasers acknowledge and agree that: (a) the number of participants in the draw is an estimate only and may exceed any figure mentioned in marketing materials; (b) any increase in the number of participants or any change in the odds of winning does not constitute a defect in the membership, the discount portal, or the goods/services supplied; and (c) no refund, cancellation, or compensation will be provided on the grounds that the number of participants or the odds of winning have changed or are different from any marketing representation. Refunds will only be considered in accordance with Australian Consumer Law where there is a major failure in the membership product or discount portal itself (unrelated to participant numbers or odds). All other sales are final.

PART B

1. Information on how to enter and information provided in Part A form part of these terms andconditions and by entering into this Competition, each Entrant is deemed to have accepted and understood these terms and conditions. The Entrant agrees that these terms and conditions constitute all of the terms and conditions between the Entrant and the Promoter governing this Competition.

Participation

2. To enter, Entrants must meet all of the Entry Requirements to enter the Competition as set out in the Schedule. The Entrant warrants and represents to the Promoter that it meets all of the Entry Requirements.

3. Entry is open to residents of the Territories.

4. The Competition will be open during the Promotion Period. All eligible entries must be received by the Promoter during this time. Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission by the Entrant.

Selection of Winner

5. The Winner will be selected by random draw, on the dates and at the location outlined in Part A. Entries that are incomplete or incomprehensible will be deemed invalid and will be ineligible to win.

6. Prizes will only be awarded to the person named on entry, subject to their entry complying with these terms and conditions.

7. If for any reason, a prize or element of a prize is unclaimed by the Winner within 3 months of the Draw Date (i.e. by the Draw Dates set out in the Annexure) despite reasonable steps by the Promoter to contact the Winner, the prize will be re-drawn on the dates and at the times as set out in the Annexure, at the Head Office.

8. The Winner of the re-drawn prize will be:

(a) notified by email within 7 days of the re-draw;

(b) announced online at the Promoter’s Website within 7 days of the re-draw; and (c)

published on the Promoter’s social media accounts within 30 days of the re-draw.

9. The Entrant is solely responsible for ensuring that it is eligible to be a Winner, and the Promoter will not be in any way liable to an Entrant, should the Entrant be found to be ineligible to win the Competition.

Prizes

10. Prizes are provided on an “as is” basis and the Promoter will not make any modifications to the Prizes at the Winner’s request.

11. The Promoter will not be liable for any delivery of prizes to a wrong address or account due to any error by the Winner.

12. If the Winner claims a prize but is found to be in eligible or if the Winner does not provide valid delivery details within the time frame specified by the Promoter, the Winner forfeits the Prize and it will not be re-drawn.

13. The Promoter will not be liable for re-drawing or providing a replacement prize for any Prizes that are not received by the Winner due to being lost in transit, stolen or due to any failure to accept delivery by the Winner or due to any error in details provided by the Winner.

14. The Prizes may contain goods or services from 3rd party brands. Unless otherwise specified, the provision, advertisement or offer of prizes from a 3rd party brand does not constitute any sponsorship, approval or endorsement of the good, service, content, policies, practices or services offered by those parties.

15. Where a Prize is specified to be delivered directly from the 3rd party prize supplier, as a condition of entry, the Winner agrees that its details may be provided to the 3rd party prize supplier by the Promoter on its behalf for the purpose of delivery of the Prize to the Winner.Personal information

16. As a condition of entering this Competition, Entrants agree to provide personal information to the Promoter. Personal information collected during the course of this Competition will be dealt with in accordance with the Promoter’s Privacy Policy, located at the Promoter’s Website. Personal information submitted may be provided to third parties for the purpose of administering this Promotion and distributing the prizes, including to agents, contractors and prize suppliers. The Promoter may also use this personal information to contact you regarding, marketing, offers or Promotions from time to time.

17. As a condition of entry, each Entrant agrees that the Promoter may use their name (either in full or in part), likeness, voice and image (including any photograph and film) in any marketing and promotion of any products manufactured, distributed and/or supplied by the Promoter, for an unlimited period of time and the Winner will not be entitled to any fee for such use.

Intellectual property

18. By uploading, publishing, transmitting or making available any data, content or other material in connection with this Competition (Entrant Content), the Entrant agrees to grant the Promoter, its affiliates, licensees and successors a non-exclusive, royalty-free, perpetual, irrevocable, worldwide and fully sub-licensable right to use, communicate, reproduce, modify, adapt, publish, publicly perform, translate, create derivative works from, distribute and display in any form, any such content, including but not limited to text, images, videos, graphics, audio and photographs without attribution.

19. The Entrant warrants and represents that:

(a) it holds all the intellectual property rights to the Entrant Content;

(b) it has the authority and licence to upload, make available and licence the Entrant Content to the Promoter; and

(c) the Promoter’s use of the content will not infringe or violate any third-party rights, including but not limited to defamation, intellectual property rights, moral rights and privacy rights and will not give rise to an obligation to make any payment to a third party.

20. The Entrant agrees that they are solely liable for the Entrant Content and that, to the fullest extent of the law, the Promoter shall not be liable in any way for such Entrant Content.

Reservation of rights

21. The Promoter reserves the right to request each winner to provide proof of identity or proof of residency at the address specified in their submission in order to claim a prize. Proof of identification and residency is at the absolute discretion of the Promoter. In the event that a Winner cannot provide suitable proof, the Winner will forfeit the prize and no substitute will be offered.

22. The Promoter may, in its absolute discretion, modify or cancel the Competition and may administer this Competition in the manner that it considers appropriate in accordance with Australian law, including where the Competition is not capable of running as planned, such as where there has been infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the Competition.

23. The Promoter reserves the right in its sole discretion to disqualify any Entrant that has, or

is suspected by the Promoter to have:

(a) breached any of these terms and conditions;

(b) tampered with the entry process or the Competition;

(c) engaged in any unlawful conduct;

(d) engaged in any other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition or the reputation of the Promoter.

Social Media Platforms

24. The Competition is in no way sponsored, endorsed or administered by, or associated with www.instagram.com and its related mobile application, or any other social media platforms (Social Media Platform(s)).

25. The Entrant agrees that it releases the Social Media Platforms from any and all liability to the Entrant arising out of or in connection with the Competition.

26. The Entrant must not:

(a) harass or bully any other person, use offensive language, use language that defames the Promoter, or use language that negatively impacts or intends to negatively impact the reputation of the Promoter;

(b) use electronic programs, bots or similar technology to automatically submit entries;

(c) use multiple Social Media Platform accounts to enter the Competition; or

(d) tag other accounts owned or controlled by the Entrant to enter the Competition and agrees that it will only tag genuine friends or family in their entry, and the Promoter reserves the right to disqualify any Entrant or Entry that breaches these terms and remove any such entries from the Competition.

Exclusion of liability

27. The Promoter will not be liable for any late, lost or misdirected entries including due to technical disruptions, delayed or misplaced postage, network congestion or for any other reason. To the maximum extent permitted by law, the Promoter will not accept any liability for any error, omission or failure to administer this Competition.

28. Except for any liability that cannot be excluded by law, all Entrants release, and indemnify and hold harmless the Promoter (including its officers, employees, agents and contractors), from and against, all liability (including negligence), actions, claims, costs, losses or expenses arising out of or in connection with: any act, omission, negligence, fraud, wilful misconduct or breach of these terms and conditions by the Entrant, its nominees or agents and the Entrant or Winner’s acceptance of, use of or attempted use of any prize(s) and participation in the Competition, including (but not limited to) loss of income, damage to property and personal injury whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.

29. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees, agents and contractors) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following:

(a) inaccurate or incorrect transcription of entry information;

(b) any technical difficulties or equipment malfunction, malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment, or software (whether or not under Promoter ’s control);

(c) the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any website;

(d) any theft, unauthorised access or third party interference;

(e) electronic or human error which may occur in the administration of the Competition;

(f) any variation in prize value as stated in the Schedule;

(g) any tax liability incurred by a Winner or Entrant;

(h) redemption or use of a prize; and

(i) any act or omission, deliberate or negligent, by the Promoter, or its employees or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a Winner and, where applicable, to any family/persons accompanying a Winner.

13. To the maximum extent permitted by law, the Promoter’s total aggregate liability to the Entrant under or in any way connected with these terms and conditions and the Competition, or the performance or non-performance of these terms and conditions is limited to an amount equal to any amounts paid by the Entrant to the Promotor in the three (3) month period immediately preceding the date on which the relevant claim arose, which may be zero.

General

30. These terms and conditions are governed by and will be construed under the laws of Western Australia and the parties agree to submit to the exclusive jurisdiction of the courts of Western Australia and its appellate courts.

31. Any times and dates referred to in these Terms and Conditions refer to the timezone of Victoria, Australia.

32. Failure by Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

33. Capitalised terms used throughout these terms and conditions are defined in the Schedule unless specified otherwise.

34. Marketing vs Terms and Conditions: Any statements or representations appearing in marketing materials, advertisements, social media, website banners, or elsewhere regarding the number of participants, odds of winning, or any other aspect of the Promotion are for promotional purposes only and are subject in all respects to these official Terms and Conditions. In the event of any inconsistency between marketing materials and these Terms and Conditions, these Terms and Conditions prevail. Entrants and purchasers acknowledge that they have been given a clear opportunity to review these Terms and Conditions prior to entering or purchasing and that they enter/purchase on that basis. By entering or purchasing a membership in connection with the Promotion, each person agrees to be bound by these Terms and Conditions in their entirety.

Annexure A – Prize Details (Lamborghini Giveaway)

Promotion Name: Falms Rewards – Lamborghini Huracán 24 Hour Experience Giveaway

Prize Description

The prize consists of a $2,500 AUD voucher to be used toward a supercar rental experience. The voucher is intended for the hire of a Lamborghini Huracán (or similar vehicle, subject to availability) for approximately 24 hours.

The voucher may be used with a supercar rental provider of the Winner’s choice, subject to that provider’s availability, terms and conditions.

The Promoter does not own, supply, or operate the vehicle and is not affiliated with or responsible for the rental provider or the services provided.

Prize Value

The approximate retail value of the prize is AUD $2,500. The final value may vary depending on the rental provider selected, availability, and pricing at the time of booking.

Prize Conditions

The Winner must comply with all requirements of the selected rental provider, including but not limited to age requirements, driver’s licence requirements, identification, and security checks.

All additional costs associated with redeeming and using the prize are the sole responsibility of the Winner, including but not limited to security deposits or bonds, insurance, excess liabilities, fuel, additional kilometres, delivery or collection fees, and any damages or penalties incurred during the hire period.

The Promoter is not responsible for any refusal of service, cancellation, changes to booking terms, or availability issues imposed by the rental provider.

If a Lamborghini Huracán is unavailable, the Winner may select an alternative vehicle of similar value or apply the voucher toward another booking.

The prize is not transferable or exchangeable beyond the options stated.

Cash Alternative

The Winner may elect to receive a cash alternative of AUD $2,000.

If the cash alternative is selected, the Winner will not receive the voucher or any associated experience. Once selected, this choice is final and cannot be changed.

Winner Selection

The winner will be selected at random using an independent system, Random Draws Australia. The draw will occur on the advertised draw date or immediately once all available spots are filled, whichever occurs first.

Winner Notification

The winner will be contacted via the email address and/or phone number provided at the time of entry. The winner may also be announced on Falms Rewards social media platforms.

Prize Delivery

If the voucher is selected, it will be delivered electronically to the Winner’s nominated email address within a reasonable timeframe.

If the cash alternative is selected, payment will be made via bank transfer to an account nominated by the Winner.

General

This annexure forms part of the overall Terms and Conditions of the promotion. By entering, participants agree to these prize details.
